According to the B.C. Information and Privacy Commissioner’s 2026 guidance on AI scribes, patients have the right to decline or withdraw consent. Healthcare organizations remain responsible for their obligations under PIPA when contracting with an AI scribe company. The guidance covers private practices and most primary care clinics, and stresses keeping a human in the loop. A clinic in Burnaby or Richmond settles consent and the vendor contract before the first recorded visit.
According to the Province of British Columbia’s guidance on disclosures outside of Canada, updated in 2025, public bodies must complete an additional assessment when sensitive personal information is disclosed to be stored outside of Canada. The rule follows amendments to the Freedom of Information and Protection of Privacy Act enacted on November 25, 2021. A supplier to a health authority, university or city can expect questions about where its AI tools keep data.
A privacy check before any pilot
The privacy reading from the table above comes first, because it decides which tools may be used. After that, a Vancouver project tightens access, pilots with one team and measures the result.
- Scope and privacy check. Name the task, the data it touches and the rule that applies. The proposal sets the fee and the finish line.
- Tighten sharing. Old links in SharePoint, OneDrive and Teams are closed before any AI tool is switched on, so its answers stay inside each person’s access.
- Pilot with one team. A small group uses it on real work. The tool sends no email and changes no record until a named person approves it.
- Measure, then widen. Hours saved in the pilot decide whether the next team gets it.
